Commercial Real Estate Attorney Dallas, TX
Commercial real estate refers to real property zoned, used, or held for commercialization or development for business purposes. This includes land and structures used for industrial, office, agricultural, retail, and other market-driven purposes whether private, public, or private-public collaboration projects. Real estate developers are the visionaries who, with access to capital, transform raw land into thriving economic centers.
When I first came to Dallas, Texas in my twenties, I met such a real estate visionary. I can’t recall his name, but every time I saw him, he was engrossed in a real estate magazine. With a wide smile, as though searching me out in particular, he would encourage me to get into real estate investments, sharing his grand visions for the future growth of Dallas.
At that time, North Dallas ended at Northwest Highway, and Plano was mostly dusty farmland with hay fields and little else beyond. I remember asking the developer once where the Dallas metro area would grow. With that familiar smile, he said, “Clean up to Oklahoma, straight north between the hatch tags of Preston Road and Central Expressway.” When I asked about the south of downtown, he smiled again and said, “Warehouses, truck stops and other industrial use.”
I remember wondering—how could he be so sure? Did he belong to a business club or something? A drive around Dallas today would convince anyone that he knew exactly what he was talking about. Dallas has grown into an internationally recognized major metropolitan hub, and it continues to expand its commercial real estate and economy.
Why Due Diligence is Critical in Commercial Real Estate Transactions
One key lesson I learned from the real estate developer was the importance of location in real estate. He would say that “location is everything” in the real estate investment business. Conducting due diligence in commercial real estate areas should include:
- Property’s suitability for intended purpose
- Property’s prior condition and use
- Property’s encumbrances, such as tax liens, etc.
- Property’s use restrictions and zoning laws
- Surrounding properties and neighborhood conditions
- Local government’s development goals for the area
- Geology and other environmental concerns that could affect the property
