Who Qualifies for EB-1?

The EB-1 visa has three main categories:

EB-1A: Extraordinary Ability

To qualify, you must demonstrate extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim. This can be shown by a one-time major award (like a Nobel Prize) or at least 3 of the following 10 types of evidence:

  • Awards for excellence
  • Membership in associations requiring outstanding achievement

Applicants must have at least 3 years of teaching or research experience and international recognition for outstanding achievements in their field. You must be coming to the U.S. to pursue tenure or tenure-track teaching or a comparable research position at a university, higher education institution, or private employer.

You must provide evidence of at least 2 of 6 criteria:

  • Major prizes or awards for outstanding achievement
  • Membership in associations requiring outstanding achievement
  • Publications about your work in professional journals
  • Participation as a judge of others’ work
  • Original scientific or scholarly research contributions
  • Authorship of scholarly books or articles in internationally circulated journals

Your U.S. employer must file Form I-140 on your behalf and demonstrate the ability to pay the offered wage.

EB-1C: Multinational Manager or Executive

Applicants must have at least one year of managerial or executive experience in the last three years with a multinational company and be coming to the U.S. to work in a managerial or executive role. Your U.S. employer must file Form I-140 on your behalf and demonstrate the ability for pay the offered wage.

Next Steps After I-140 Approval

Once your EB-1 petition (Form I-140) is approved:

  • If you are in the U.S. and eligible, you can apply to adjust status to permanent residency (Form I-485).
  • If you are outside the U.S., you will apply for an immigrant visa at a U.S. consulate.
